Easyjet Hammers Home that there will be no reimbursement

I booked a package £ 609 through Easyjet holidays to Spain. Shortly afterwards, Easyjet notified me that there was building work in the hotel. I got the opportunity to continue the trip or change the vacation and pay a price difference. Equivalent packages cost more, and since I was under great stress, I wanted a week on a construction site, so I asked for a refund, but Easyjet refused.

The Easyjet alarm is certainly discouraging because the announced hotel was in a “quiet” place. It warned that the hammering of the hammers was probably 11 hours a day while the front of the hotel was repaired. However, since the facilities were still open, they did not qualify for a refund.

Surprisingly, this seems to be supported by the rules. The parcel travel regulations claim that there is a refund if the main feature of a vacation is changed, but it is silent about loud buildings. The Code of Conduct from ABTA says that if the construction work has no effect on the hotel facilities, no reimbursement is due. Katherine Allen from the law firm Hugh James says you could have a case if the holiday was sold on the basis of the calm, the work was extensive and another hotel with the same quality could not be found.

Easyjet Holidays says: “The construction work was rated as” moderate “, which means that they have an insignificant effect. We contacted JT as soon as we were made aware and offered the opportunity to book an alternative. ”
